In a case with an ironic twist, the 3rd Circuit allowed plaintiffs from a settled asbestos class action to pursue their own class action for breach of fiduciary duty against their lawyers. The plaintiffs claimed their lawyers pushed a greater percentage of aggregate settlements to some clients because the lawyers received higher cuts of the settlements.
