Motorists hitting the road over the Christmas holiday will get the gift of lower gasoline prices, as prices at the pump have fallen to another 2018 low. Missouri Supreme Court refuses to enforce arbitration based on unavailability of specific arbitrator identified in arbitration agreement. After reviewing the language of the agreement, the court held that the parties agreed to arbitrate before – but only before – NAF and, as a result, the circuit court did not err in refusing to compel Hunter to arbitrate before some other arbitrator under the auspices of section 5 of the FAA.
