For the Lawyers

CFPB does not owe attorneys fees—case not brought in bad faith. A federal judge rejected a request that the CFPB pay the law firm’s legal bills after the agency failed to prove in July that the law firm misled consumers with debt collection letters. The judge’s order found “no indication” that the agency’s lawsuit against the law firm was meritless, improper or brought in bad faith, pointing to evidence at trial. The judge stated, “Although it may well be unjust that Weltman has suffered reputational harm and has had to expend significant resources defending itself from disproved charges in this action, the bureau’s actions do not rise to a level that would permit the court to award attorney fees.” Consumer Financial Protection Bureau v. Weltman Weinberg & Reis Co. LPA, case number 1:17-cv-00817, in the U.S. District Court for the Northern District of Ohio. Click here for more.
