Credit union must face suit over misleading overdraft policy. The largest credit union in New England must face a proposed class action by customers who say its overdraft policies are unclear. A Massachusetts federal district court judge ruled Thursday, upholding breach of contract claims while tossing other claims for equitable relief. The judge stated, "I find that plaintiff has plausibly argued that the contracts, even when construed together, are ambiguous as to whether they use the 'available balance' method to determine whether an account has been overdrafted," he said. "This ambiguity presents a factual dispute not appropriate for resolution on this motion.” Salls v.
