The Eleventh Circuit ruled Wednesday that class arbitrability should be decided by a court if an arbitration clause is silent on the issue, but sent a dispute over class arbitrability between consumers and a prison contractor to an arbitrator after determining that the terms of service agreement clearly states that was the parties' preference.
