Enrollment in Obamacare Surges After Trump's Election

More than 100,000 people selected plans through the federal Obamacare exchange, healthcare.gov, since Tuesday according to the Department of Health & Human Services. It was the busiest day since open enrollment began on Nov. 1, when around 95,000 signed up. According to the Obama administration 11.4 million people are expected to enroll in 2017. Click here for more.

The Consumer Financial Protection Bureau is facing an uncertain future in President-elect Trump's administration. The CFPB is currently appealing a recent court of appeals ruling that held that the structure of the CFPB is unconstitutional. The court in PHH Corp. v. CFPB ruled that the president must have the power to remove a CFPB director without cause. While Republican lawmakers are likely to focus on efforts to replace the agency's single director with a bipartisan five-member commission, as well as subject it to the Congressional appropriations process, President-elect Trump may seek to take more immediate action once he takes office in January. Even if the CFPB does appeal, Trump could remove CFPB Director Richard Cordray and appoint a new director who would drop the appeal. Whether Trump could succeed is uncertain, and is likely to turn on whether the CFPB can convince a higher court to delay a decision in the case of PHH Corp. v. CFPB. "As long as the PHH decision is stayed pending further appeals, the director can only be removed for 'inefficiency, neglect of duty, or malfeasance in office.'" Click here for more.
