Continuing Feud between Apple and the Justice Department

A California court ordered Apple to unlock an iPhone to help the Justice Department extract data from the iPhone used by a gunman in the San Bernadino, California terrorist attack last December. Apple has refused to comply. This case has set off a fierce debate over privacy and security. Any further court decisions in this case is likely to be appealed and could reach the Supreme Court.  Click here for more.

Debt Collector establishes bona fide error defense. The U.S. District Court for the Southern District of Alabama recently granted summary judgment in favor of a mortgage loan servicer and the trustee of a mortgage backed securities trust in a putative class action alleging violations of the federal Fair Debt Collection Practices Act (FDCPA), ruling that the “bona fide error” defense applied to the servicer and that the trustee was not a “debt collector” under the FDCPA.
