Consumer Financial Protection Bureau Recovers Money for Consumers

On March 8, 2016, the Consumer Financial Protection Bureau (CFPB) announced that it recovered $14.3 million for approximately 228,000 consumers. Using its supervisory and examination authority, the CFPB discovered violations in the money transmitter, student lending, and debt collection markets. In a current scam still operating, 896,000 people have been called by would-be swindlers, and more than 5,000 victims have handed over $26.5 million. Arbitration agreement is unconscionable. The Montana Supreme Court affirmed a finding that an arbitration agreement was unconscionable and unenforceable. The court noted that where a party specifically challenges the validity of the arbitration clause, and not just the entire contract, it is the court that determines the validity of the arbitration clause. It also found that the arbitration provision lacked mutuality of obligation, was one-sided, and contained terms unreasonably favorable to the drafter. Global Client Solutions, LLC v.
