J.C. Penny Pays $50 Million to Settle Claims of Deceptive "Sales" Pricing

J.C. Penny settled a California false advertising lawsuit by making $50 Million available in a fund to reimburse consumers. The complaint alleged that J.C Penny violated California law by 'price anchoring,' where they advertise an item on sale by listing the "original price" with the "sale" price, but overstate the "original price" to make the discount appear bigger. Click here for more.

Discovery request seeking Plaintiff's Facebook log-in information and authorization to log in as Plaintiff ruled overly intrusive and overbroad. Federal District Court rules that while tailored discovery request reasonably could compel production of discoverable Facebook posts as determined by Plaintiff's counsel, a request for log-in information and the authorization for Defense counsel to search the Facebook account was overly intrusive.
