Failing to raise arbitration during class certification results in waiver. The Tenth Circuit held that Cox Enterprises assertion of the arbitration clause in its contracts with its cable customers, made after class certification and more than two years after the first motions in the action, was an inequitable assertion of the argument, and that the long delay in asserting a known argument resulted in its waiver.
