Mazda Gives New Miata to Owner of the First Crashed 2016 Miata

The first wreck involving the newly redesigned Mazda Miata MX-5 appears to have happened in in Jacksonville, Florida last week when the proud new owners were rear-ended by a Ford F-150 only a mile away from picking up the car at the dealership. Because the car suffered frame damage, and resolving the insurance claims and doing the repairs would take weeks, Mazda North America made the surprising decision to give the disappointed new owners a brand new launch edition Miata to begin enjoying as soon as it can be delivered to the dealership. The right to challenge an arbitration award on grounds set forth in the Federal Arbitration Act cannot be waived by contract. A Georgia appellate court has held that a contract restricting the challenging of an award impinges on the Georgia Arbitration Code (which is analogous to the Federal Act) and is unenforceable. Thus, the losing party in the arbitration can pursue an action in court to vacate or modify the award pursuant to state and federal arbitration law. Atlanta Flooring Design Centers, Inc. v. R.G.
