The Eleventh Circuit Court of Appeals reaffirmed that enforcement of a security interest alone is not debt collection regulated by the Fair Debt Collection Practices Act (FDCPA). The court ruled that the publishing of foreclosure sale notices in a newspaper were to inform the public of the sale, and because they were not addressed to the debtors, and did not contain any reference to the collection of payments from them, that was debt collection under the FDCPA.
