The People’s Lawyer’s Tip of the Day

Your obligation to pay your credit card bill on time is satisfied when the check is received, not mailed. It is your responsibility to mail the check early enough to arrive before the due date. A good way to solve the problem of delayed mail is to pay your bill online.

Set Clocks Forward This Sunday

Don't forget to set your clocks forward an hour on March 8! Daylight Savings officially begins this Sunday at 2:00 A.M. That means, once the clock strikes 2:00 A.M. Sunday morning, it will actually be 3:00 A.M.

This year, Daylight Savings time will end on Sunday, November 1 at 2:00 A.M.

Daylight Savings initially started as a way to conserve energy during times of war. In fact, year-round Daylight Savings Time has been implemented nationwide on multiple occasions.

Tinder Starts Charging

This month, the popular online dating app, Tinder, launched its new premium service, Tinder Plus. Unlike its predecessor, Tinder Plus charges users a monthly fee to meet other singles. In return, Tinder has made some major modifications to help users find a match. Notably, Tinder users can now search for a match anywhere in the world, regardless of current location. Also, Tinder users can now take advantage of a "Rewind" feature that allows users to take a second look at a profile they initially discarded.

Although Tinder is quiet on details, it appears that users under 30 years old will pay $9.99 a month, while users 30 years old and over will pay $19.99 a month.

Since its launch in August 2012, an estimated 50 million people have signed up for Tinder. However, those 50 million used the service for free. Will consumers continue to use Tinder as it moves behind a pay-wall?

For the Lawyers

Arbitration agreement is unenforceable.

The Ninth Circuit held that the arbitration agreement Sirius XM Radio relied upon was not enforceable because the user did not know he had any agreement with Sirius XM, let alone an arbitration agreement.

The plaintiff purchased a Toyota truck. The truck came with a 90-day trial subscription to Sirius XM satellite radio. The plaintiff did not have to sign any documents to receive or activate the radio. It was activated just after his purchase.

The court noted that “[h]ere, by contract, there is no evidence that Knutson purchased anything from Sirius XM, or ever knew that he was entering into a contractual relationship with the satellite radio service provider.”
