P.F. Chang's Investigates Data Breach

Don't look now! Yet another massive data breach has hit another major company. This time, P.F. Changs is running damage control after a consumer watchdog alerted the public that thousands of credit and debit cards used at P.F. Changs flooded the secondary market, meaning the company had a data breach. The company believes the breach occurred from March through May of 2014.



Have you eaten at P.F. Changs? Examine your credit card statement closely! If you're particularly worried, contact your credit card company by phone and ask for a replacement card.

IRS Scam Still Going Strong

Even though tax season is over and most people have already turned in their taxes, scammers are still turning out great business ripping off American taxpayers.



The scam goes like this...



You receive a phone call from someone who claims to work for the IRS. He'll convince you that you owe a large sum of money, then insist that it be paid immediately by prepaid debit cards. After the cards are purchased and activated, you'll be asked to read the unique, identifying numbers on each card. Once that's done, your money is gone.



Although tax season is long since over, people are especially sensitive to IRS demands. The scammers are so good that they've found a way to make it seem like they're calling from an actual IRS number, will read of "badge numbers," and may even know the last four of a victim's social security number.

Implied warranty of merchantability runs to subsequent purchasers.

The Texas Supreme Court held that a subsequent buyer may sue the manufacturer for breach of the implied warranty of merchantability. For procedural reasons the court did not discuss the issue of whether the warranty was properly disclaimed, and what affect a disclaimer would have on subsequent purchasers.
