It is illegal in Texas to charge more to someone who pays with a credit card. It is legal, however, to give a discount for cash. This discount is for the savings to the merchant who does not have to pay the fee that the credit card company charges.

AT&T Set to Buy DirecTV for $50 Million

AT&T has closed in on a deal to buy the number one satellite provider in the United States. Recently, it became public knowledge that AT&T has been actively perusing the purchase of DirecTV for an estimated $50 billion. AT&T is already in the cable business with its U-verse services. The AT&T and DirecTV deal comes just after the merger of Comcast and Time Warner.

For the Lawyers

Cancellation of satellite television contract ten days into a twelve-month contract is “immediate cancellation.”

The Arkansas Supreme Court held that a consumer was not bound by an arbitration clause because she did not accept the terms of the contract when she cancelled the agreement. Although the defendant argued that she “terminated” the agreement by her continued use, the court held nine or ten days of use in a twelve-month contract was closer to “immediate termination.”
