The People’s Lawyer’s Tip of the Day

Are you having a dispute with your Homeowner’s Association over a small amount of money? Disputing it could cost you a lot in attorney’s fees and interest if you continue to fight. On the other hand, if you pay it “under protest” you can then file a small claims case in justice court to get your money back. This is a good way to get your dispute heard by a judge, without adding to your costs. Make sure your payment is clearly marked, “paid under protest.”

GM Issues New Recall for 1.5M Vehicles

Following the General Motors ignition switch problem, the company ordered a comprehensive internal safety review.



Following the review, GM issued three new recalls affecting more than 1.5 million vehicles. Two of the recalls are related to airbag systems. The third relates to the the brake system. In anticipation of paying for all the recalls, GM charged $300 million against first quarter earnings.

CFPB Investigates Money Mutual

You have likely seen MoneyMutual commercials starring Montel Williams on television, advertising short terms loans to cash-strapped consumers.



After receiving numerous complaints, the Consumer Financial Protection Bureau hit MoneyMutual with a Civil Investigative Demand, which allows the CFPB to investigate MoneyMutual's business practices. The investigation is to determine whether the company has “engaged or [is] engaging in unlawful acts or practices in connection with the marketing, selling or collection of payday loans.”

Right of rescission expires upon the sale of property.

Notice of rescission is not sufficient to exercise the right of rescission. The Eight Circuit held that a consumer did not preserve his right of rescission simply by giving notice prior to the foreclosure sale of his property.
