The People’s Lawyer’s Tip of the Day

As a general rule, a tenant can't terminate a lease because of criminal activity at an apartment complex. However, if the tenant can show the landlord was somehow at fault, for example not maintaining appropriate security gates or lights, he may be able to terminate the lease.



A Texas law allows the victim of a sexual assault to terminate a lease by giving the landlord 30 days notice.

4.2 Million Sign Up for Obamacare

In January, only 2.2 million people had signed up for health insurance using the new exchange marketplaces created under the Affordable Care Act. Through February, that number ballooned to more than 4.2 million people.



The Congressional Budget Office anticipates 6 million people to enroll through the exchanges in 2014. Insurers say that actual enrollment numbers have been close to the expected numbers. With the deadline set for the end of the month, about 1.8 million more people will need to register to hit the target number.



One major hiccup in sign-ups has been getting consumers to complete the process. In order to complete enrollment, consumers must pay their premiums before the deadline. According to analysts, many consumers have accidentally skipped that part of the process.

How to Get Rid of Telemarketers

Three-year period for rescission contained in Truth in Lending Act runs from consummation of loan.

The Court of Appeals of Kentucky held that in a Truth in Lending suit, the three year period for rescission is not a statute of limitations but rather a bar to the right of rescission.

The court also noted that a claim for actual damages must be based on evidence directly relating to the non-disclosure. Finally, the court affirmed a substantial reduction in the award of attorney’s fees based on the limited success achieved.
