For the first time in two years, Apple is expected to unveil a brand new iPhone. This time last year, Apple introduced an upgraded version of the iPhone 4. GoDaddy's Massive Outage Not From HackOn Monday, millions of GoDaddy-hosted websites went dark. According to GoDaddy, its services were fully restored by 7PM EST. During the downtime, an alleged member of the infamous hacker-group Anonymous took to the Internet to take credit for the outage. Despite the confession, representatives from GoDaddy were quick to tell a different story. According to interim CEO Scott Wagner, hackers had nothing to do with the outage. However, the arbitration clause in his credit card agreement explicitly waived any right to class arbitration. Notwithstanding plaintiff’s argument that enforcing the arbitration clause would make it impossible for any person to effectively vindicate his substantive rights, the Third Circuit compelled individual arbitration. The court was apologetic, but firm: “Even if [plaintiff] cannot effectively prosecute his claim in an individual arbitration that procedure is his only remedy, illusory or not.” Click here for more. |
