Mandatory Brake-Throttle Override

Federal officials are recommending that all cars and trucks over 10,000 lbs. Some claims for defective hip replacement prosthesis are not preempted by Medical Device Amendments. The Fifth Circuit held that a patient's express warranty claims are preempted by the MDA, but some implied warranty claims, negligence claims, and DTPA claims are not preempted to the extent the claims are based on violations of federal requirements.
