The People’s Lawyer’s Tip of the Day

Car manufacturer cannot compel arbitration. A U.S. District Court in California held that Toyota can’t compel the arbitration of class claims brought by customers who seek damages for diminution in the market value of their vehicles as a result of alleged defects that lead to incidents of sudden, unintended acceleration. The court found that as to some plaintiffs Toyota has waived the right to compel arbitration, and that as a non-signatory to the agreement it could not enforce the arbitration as to all plaintiffs.
