FDA to Review Inhalable Caffeine

The United States Food and Drug Administration is set to determine whether inhalable caffeine is safe for public consumption. AeroShot, sold in lipstick-sized canisters, has already gone on the market in France, Massachusetts and New York, but evaded FDA approval since it was sold as a "dietary supplement." Privacy: The Data Collection Arms Race

State law defamation and intentional infliction of emotional distress claims preempted by Fair Credit Reporting Act. The Second Circuit held that consumer state common law claims were preempted by the FCRA, which provides no requirement or prohibition, could be imposed under state law with respect to matters regulated by the FCRA.
