Telemarketer Abuse Statute Confounds Supreme Court

According to the Chief Justice of the Supreme Court of the United States, The Telephone Consumer Protection Act is the "strangest" statute he has ever seen. In a case before the court, Mims v. Arrow Financial Services, the Supreme Court is to answer the question of whether plaintiffs may file in both state and federal court. The seemingly simple question is actually quite complex, mainly because of ambiguous wording in the statute and potential conflicts between state and federal law. According to Justice Kagan, "the default position seems to be federal courts have jurisdiction over federal questions." Justice Sotomayor asked, "why even bother passing a federal law if it was going to give states the option to protect against this kind of conduct alone?" What do the other members of the court think?
