For the Lawyers

Punitive damages claim does not survive death of tortfeasor. The Supreme Court of Iowa held that a claim for punitive damage does not survive the death of the wrongdoer. “The sole question presented by this appeal is whether a right to punitive damages survives the death of the wrongdoer. On several previous occasions, we have held that punitive damages may not be recovered from the estate of a deceased tortfeasor. Upon our review, we are not persuaded that we should reconsider these precedents.” Click here for more.
