MERS tracking is not a substitute for recording. The U.S. District Court, District of Oregon, held that a trustee violated state law in a non-judicial foreclosure of a loan. The court found that because no assignments of the deed were ever recorded, and they were only tracked by MERS, the trustee violated the Oregon Trust Deed Act. Click here for more.
