Boeing Says Cracks Earlier Than Expected

Do you feel safe flying? Many consumers are questioning airplane safety and inspection requirements after a hole opened mid-flight on a Southwest Airlines plane last week. The hole in question was caused by "skin fatigue," common on older airplanes. Why didn't Southwest Airlines catch the cracks before the hole developed in flight? According to Beoing, the cracks appeared much earlier than they expected. As a result, Beoing is calling for all 737 airplanes to be inspected earlier than initially recommended. Additionally, the Federal Aviation Administration will require inspections for cracks on all 737'a that have flown more than 30,000 cycles, totaling 175 planes worldwide. Possibility of high costs not sufficient to defeat arbitration agreement. The Texas Supreme Court held that the party alleging unconscionability of an arbitration agreement must show the likelihood of incurring such costs. The court also held that a defendant who to led the consumer on a “wild goose chase,” by moving for arbitration when there was viable defense to the consumer’s claim could be sanctioned by the trial court.
