Verizon v. AT&T: The iPhone Battle Begins

On February 10, 2011, the mobile phone market will change dramatically. Verizon will begin selling the Apple iPhone, previously exclusive to AT&T. The iPhone will cost the same with Verizon at approximately $200. Although many of the features will remain the same between the networks, there will be some dramatic differences. Verizon runs on a CDMA network, which runs voice and internet over different tracks. Unlike AT&T users, Verizon iPhone users will not be able to surf the web or use applications during a phone conversation. Despite the distinction, some AT&T users are ready to make the switch to a more reliable network. Will Verizon be able to attract users away from AT&T? Click here for more.

For the Lawyers

Kentucky Supreme Court strikes down class action ban. The Kentucky Supreme Court held that a contractual ban on class action litigation is void and unenforceable. The court also determined that: 1) the Service Agreement's choice of law provision is not enforceable, and Kentucky law, rather than New York law, is applicable; 2) the Service Agreement's general arbitration provision is not unconscionable; and, 3) the provision imposing a confidentiality requirement upon the litigants to arbitration proceedings is void.
