Wrongful death claimants are bound by a patient’s arbitration agreement with his doctor. The plaintiff’s husband died after receiving treatment from the defendant for a fractured hip. The plaintiff and her adult children sued the defendant for medical malpractice and wrongful death. The California Supreme Court ruled that the plaintiff and her children were bound by the arbitration clause, despite not being signatories to the agreement. Click here for more.
