Arbitration award can not be challenged on the basis of non-statutory, judicially-created grounds. The Eleventh Circuit held that a consumer could not seek to overturn an arbitration award against her on the basis of non-statutory, judicially-created grounds. The court stated, “We hold that our judicially-created bases for vacatur are no longer valid in light of Hall Street. … [T]he categorical language of Hall Street compels such a conclusion. As [the plaintiff] has failed to demonstrate the existence of any of the statutory grounds for vacating or modifying the arbitrator’s award, the district court was bound by §9 of [the Federal Arbitration Act] to confirm the award.” Click here for more.
