How you complain makes a difference. Electronic messages are taken more seriously than a phone call, but a certified letter is taken more seriously than anything electronic.  Click here for more.

New Scam Exploits FTC Name

What would you do if someone called you and said he was from the Federal Trade Commission? Most consumers would likely listen closely, given the notoriety and credibility of the commission. Understanding the opportunity to capitalize on consumers willingness to trust and act on Federal Trade Commission recommendations, a group of scammers took the chance to exploit the name of the Federal Trade Commission and dupe consumers along the way. Someone claiming to be from the Federal Trade Commission will call a consumer and tell her she has won a lottery or sweepstakes. In order to claim the prize, the consumer must provide personal information, including account numbers. The scammers then use the personal information to take money from the unsuspecting consumer. Remember - caller ID can deceive. Just because the call comes from the "Federal Trade Commission" doesn't mean it is actually the real FTC. If you receive a call from the "Federal Trade Commission," be cautious. To read about this scam, Click here for more.

For the Lawyers

Contract update with arbitration clause, opt-out and no class action provision, was enforceable. The U.S. District Court for the eastern District of Tennessee held that a customer could not avoid enforcement of an arbitration clause that he received twice by arguing that he did not read it or that it was part of an unconscionable contract of adhesion. “There is nothing exceptional or unduly harsh about the arbitration provision in this case. This is an ordinary case, where the plaintiff did not read the arbitration provision and is now trying to escape his responsibilities.” Click here for more.
