Obama Defends Consumer Protection Agency

Texas attorney’s fees provision requires party to “gain something.” Chapter 38 of the Texas Civil and Practices Code provides for the award of attorney’s fees to a prevailing party in a breach of contract suit. The Texas Supreme Court held that to “prevail” a "party must (1) prevail on a cause of action for which attorney's fees are recoverable, and (2) recover damages." Click here for more.
