Dell Ordered to Pay $4 Million

This week, New York Attorney General Andrew Cuomo reached a settlement with computer manufacturer Dell. As part of the settlement, Dell must change its warranty, advertising, and debt collection practices. Additionally, the agreement calls for $4 million to be paid back to consumers. Ticketmaster Attempts to Eliminate Scalpers

Debtor can claim vehicle expense in bankruptcy. The Eight Circuit held that a Chapter 13 debtor could claim a vehicle-ownership expense in his bankruptcy case, even though he owned his vehicle outright. In doing so, the court join the Fifth and Seventh Circuits in construing the plain language of 11 U.S.C. ยง 707(b)(2)(A)(ii)(I) to permit a debtor with above-median income to claim a vehicle-ownership expense for a vehicle that the debtor owns outright and without encumbrance.
