Fair Credit Reporting Act does not require actual damages. The Sixth Circuit held that a plaintiff is not required to show actual damages in order to sue check verification services for erroneously reporting the status of thousands of consumer accounts. The court noted that the FCRA’s private right of action does not require proof of actual damages as a prerequisite to the recovery of statutory damages for a willful violation of the Act.
