Attorney General Charges Conn's with Failing to Honor Warranties

On Thursday, Texas Attorney General Greg Abbott announced a lawsuit against appliance and electronics giant Conn's. To date, more than 2,000 complaints have been filed with the AG's office, charging Conn's of failing to honor product warranties, misleading customers about the nature of its products, false advertising and other violations of the Texas Deceptive Trade Practices Act. GM Moves Closer to Bankruptcy

In an effect to further streamline operations, major General Motors bondholders have agreed to an offer that gives them an increased stake in GM in return for various concessions. Despite the agreement, many expect GM to enter bankruptcy within the next few days. Court certifies debt collection class action claim against law firm. A federal district court in Connecticut certified a FDCPA class action based on letters, finding the letters were similar in material respects and that the differences go to the merits of the class action claims. The court noted that given the common content of the letters sent directly to consumers, the commonality test had been met. The court found the letters to the attorneys were sufficiently similar to warrant class action treatment, and even if different could be addressed by dividing the group into two classes. The typicality test was satisfied because Wolpoff “failed to identify any unique ‘claims or defenses.’” Click here for more.
