Obama Outlines Cybersecurity Plans

District court holds class action ban in arbitration clause is unenforceable. The United States District Court for the Western District of Washington has found a class action ban is unconscionable and unenforceable. The court noted that the cost of pursuit significantly outweighs the potential recovery if each of the Plaintiffs was to proceed on an individual basis. Indeed, “[t]he realistic alternative to a class action is not 17 million individual suits, but zero individual suits, as only a lunatic or a fanatic sues for $30.” Click here for more.
