The U.S. District Court for the Northern District of Texas held that an arbitration clause is unenforceable because the terms of use agreement that reserved to the Web site operator the right to unilaterally modify the agreement was an unenforceable “illusory contract. ” The court said that, in view of its determination that the contract was illusory and thus unenforceable, there was no need to discuss the plaintiff's argument that the contract was also unconscionable.
