Consumer Restitution in Marketing Scheme

The Texas Attorney General reached an agreement that resolves the state’s enforcement actions against Mannatech Inc. and its former CEO, Samuel L. Caster. In 2007, the company was charged with orchestrating an unlawful marketing scheme that exaggerated their products’ health benefits. According to a settlement secured by General Abbott, Mannatech will pay $4 million in restitution to Texas customers. Click here for more.

Cemetery liable for burial mistake. The California Court of Appeals has held that a cemetery may be liable for emotional distress damages for breach of contract where it interred a stranger in a family plot. The court noted that “substantial evidence supported the trial court’s determination plaintiff suffered serious emotional distress and that plaintiff’s reaction to the situation was not so abnormal as to preclude recovery.” Click here for more.
