The New Jersey Consumer Fraud Act applies to a bank that fails to make an investment as promised. The Appellate Division panel ruled that the client could pursue the claim because the employee failed to perform a service as advertised. The court rejected an argument that the statute does not apply to securities. The court noted that the claim was the bank failed to invest the money at all, not that it invested it badly or misled the plaintiff into investing in a bogus company. Click here for more.
