Independence Day honors the birthday of the United States of America and the signing of the Declaration of Independence on July 4, 1776. It's a day of picnics and patriotic parades, a night of concerts and fireworks, and a reason to fly the American flag.Click here for more.

The People’s Lawyer’s Tip of the Day

Have you been bothered by a door-to-door salesman? Under the law, you have three days to change your mind whenever you sign a contract negotiated in your home by a salesperson. The best advice is don't talk to any salesperson who shows up at you door. But if you make a mistake and get talked into a bad deal, the law gives you three days to cancel.

The Top Ten Internet/Email Scams

Most of you have received an email from a member of a Nigerian family with wealth. It is a desperate cry for help in getting a very large sum of money out of the country. A common variation is a woman in Africa who claimed that her husband had died, and that she wanted to leave millions of dollars of his estate to a good church. In every variation, the scammer is promising obscenely large payments for small unskilled tasks. This scam, like most scams, is too good to be true. Yet people still fall for this money transfer con game. Here you will read about this and nine other Internet scams.  Click here for more.

Protecting the Assets of Unmarried Couples

A romantic relationship does not benefit from the same laws and regulations that protect married couples. Witness the condo dispute between Jennifer Aniston and Vince Vaughn in the newly released movie "The Break-up" -- both love the jointly owned condo, and neither one wants to leave. Some 5.5 million unmarried couples dwell together, representing slightly more than 10 percent of all households. Married or not, couples are purchasing real estate and businesses together. And since it can be easier to get a divorce in this country than to resolve a property or business dispute, unmarried couples would be well-advised to sit down and circumspectly discuss all contingencies before making any big purchases.  Click here for more.

Car Ads: Reading Between the Lines

Many new car dealers advertise unusually low interest rates and other special promotions. Ads promising high trade-in allowances and free or low-cost options may help you shop, but finding the best deal requires careful comparisons. Many factors determine whether a special offer provides genuine savings. The interest rate, for example, is only part of the car dealer's financing package. Terms like the size of the downpayment also affect the total financing cost.  Click here for more.

Experian Study Reveals Consumer Debt Trend Over Past Two Years

Experian Consumer Direct, a leading provider of online direct-to-consumer credit reports, scores and monitoring, today announced the results of a nationwide study on consumer debt that shows consumers have increased their debt by more than 12 percent over the past two years. Minimum monthly payment obligations also increased by 10 percent during the same time period. Click here for more.

For the Lawyers

Four year statute of limitation applies to claim for restitution. A Texas appellate court has held that claims for restitution for unjust enrichment, like money had and received, arose out of assumpsit and are based upon quasi-contract; thus, these claims are properly characterized as based on a debt not evidenced by a writing.
